

Terms and Conditions for Mouse Music Group Ltd
1. Definitions and Interpretations
For the purposes of this agreement, the following terms shall have the meanings set forth below:
- "Client" refers to the individual or entity engaging the services of Mouse Music Group Ltd.
- "Company" means Mouse Music Group Ltd, its employees, representatives, and authorised subcontractors.
- "Staff" denotes any representative or subcontractor of Mouse Music Group present at the Event.
- "Venue" signifies the physical location where the Event is to take place, including the entity responsible for or in ownership of said location.
- "Booking" constitutes the formal engagement of the Company's services by the Client, as confirmed by the receipt of a non-refundable deposit.
- "Event" refers to the party, wedding, or other function for which the Client has secured the Company's services.
2. Booking Process and Confirmation
2.1. Initial Booking: The Company will provisionally enter bookings into its diary upon receipt of an inquiry via telephone or electronic communication.
2.2. Confirmation: A booking is only deemed confirmed upon the Company's receipt of a non-refundable deposit amounting to at least 50% of the total agreed service fee. The specific cost of services and required deposit amount will be clearly indicated in the 'Quotation Email' sent to the Client following their initial inquiry.
2.3. Balance Payment: The remaining balance is due via bank transfer or credit/debit card no later than one calendar month prior to the Event date.
2.4. Client Responsibilities: It is incumbent upon the Client to ensure that all information and details pertaining to the Event are accurate and complete. The Company shall not be held liable for any discrepancies or errors resulting from incorrect information provided by the Client.
2.5. Amendments: While the Company will endeavour to accommodate amendments to the booking, it cannot guarantee the ability to do so, and additional charges may be applicable in such cases.
3. Event Setup and Logistics
3.1. Setup and Dismantling Time: The Company's Staff will require adequate time for the installation and dismantling of equipment. As a general guideline, this process typically requires approximately one hour before and one hour after the Event. The Company will inform the Client if additional time is anticipated.
3.2. Venue Coordination: It is the Client's responsibility to ensure that the Venue is aware of the setup and dismantling times and that any associated charges are addressed.
3.3. Special Requirements: If the Client or Venue has specific requirements regarding setup or dismantling times, or if there are restrictions on access, the Client must communicate these details to the Company prior to confirming the booking. Failure to do so may result in additional charges.
3.4. Pre-Event Venue Assessment: Whenever feasible, the Company will conduct a site visit to the Venue prior to providing a quotation. This allows for a more accurate estimation of time, work, and equipment required. In instances where such a visit is not possible due to distance, venue operating hours, or other constraints, the Company will rely on information provided by the Client to formulate the quotation.
4. Cancellations, Postponements, and Refunds
4.1. Deposit Non-Refundability: All deposits paid to secure a booking are non-refundable under any circumstances.
4.2. Cancellation or Postponement Procedure: In the event that the Client wishes to cancel or postpone the Event, written notification must be provided to the Company at the earliest possible opportunity.
4.3. Date Alterations: At its discretion, the Company may agree to alter the date of the booking. Such alterations are subject to the Company's availability and must occur within 12 months of the original booking date.
4.4. Late Cancellations: If a cancellation or postponement is made less than 10 days prior to the Event date, the entire fee will be due and payable. This policy is in place due to the unlikelihood of securing a replacement booking on such short notice.
4.5. Cancellation Due to Alternative Booking: In the event that the Client cancels their booking with the Company as a result of engaging another entertainment provider, all monies already paid will remain non-refundable, and any outstanding balance will still be due in full.
5. Exceptional Circumstances and Force Majeure
5.1. Company Cancellation: Under exceptional circumstances, such as illness or severe adverse weather conditions, the Company reserves the right to cancel or subcontract bookings.
5.2. Client Options: In such cases, the Client will be presented with the option of either a full refund or the provision of a subcontracted mobile disco service.
5.3. Limitation of Liability: The Company will not be held liable for the quality of service provided by any subcontracted entity.
6. Staff Assignment and Conduct
6.1. DJ Assignment: Unless specifically requested and agreed upon in advance, any DJ from the Mouse Music Group Team may be assigned to perform at the Event.
6.2. Professional Conduct: The Company's Staff will conduct themselves in a professional manner throughout their attendance at the Venue and will endeavour to accommodate the Client's reasonable requests, provided these do not contravene any laws or Venue requirements/restrictions.
6.3. Dress Code: If the Client requires the Staff to adhere to a specific dress code, this must be communicated at the time of booking. The Company will make every effort to comply with such requests where possible.
7. Equipment and Venue Considerations
7.1. Equipment Safety: The Client shall be held responsible for any theft of or damage to the Company's equipment (including vehicles stored on the premises) caused by any individual other than members of the Company's team.
7.2. Venue Security: It is solely the Client's responsibility to ensure that the Venue provides sufficient and legally compliant security for both personnel and equipment (including vehicles used by the Company).
7.3. Equipment Setup: The Company's Staff will make every effort to set up the equipment in the most presentable and safest manner possible. However, the Company cannot be held responsible for any damage to the Venue caused by the Company's equipment.
7.4. Power Requirements: The Client must ensure that the Venue can provide a safe and practical area for the Company to set up and operate its equipment. The minimum power requirement is two 13Amp sockets, preferably on a separate and unloaded circuit. For larger venues, additional power requirements may be necessary.
7.5. Access and Parking: A suitable parking area must be available for loading and unloading the Company's equipment at the Venue. There must also be adequate and direct access to the Venue or function room. The Client is responsible for ensuring that safe and accessible parking is provided and any associated charges are covered.
8. Health and Safety Compliance
8.1. Venue Compliance: It is solely the responsibility of the Client to ensure that the Venue complies with all relevant Health and Safety regulations and holds all necessary certifications, Public Liability Insurance, and Public Performance Licenses.
8.2. Company Compliance: The Company will ensure that its equipment fully complies with all relevant Health and Safety legislation regarding both equipment and personnel.
8.3. Insurance Documentation: If required, copies of the Company's Public Liability Insurance (PLI) certificates will be supplied to the Venue free of charge upon request.
8.4. Health Warnings: The Client acknowledges that the Company's equipment produces loud volumes and flashing lights. It is the Client's responsibility to inform all attendees of potential risks, particularly those with medical conditions such as epilepsy, heart disorders, or those taking certain medications.
9. Payment Terms and Additional Charges
9.1. Deposit Payment Methods: Deposits can be paid in cash, by credit/debit card, or by bank transfer. Bank transfers are subject to a 5-day clearance period.
9.2. Extended Performance Fees: Should the Company be requested to perform beyond the agreed finish time, an additional fee of £50 per hour or part thereof will be charged. This extension must be agreed upon with the Venue and is at the total discretion of the Staff.
9.3. Parking and Toll Charges: Any parking or toll charges incurred by the Company in relation to the Event will be charged to the Client at cost.
9.4. Late Payment: If any payments are not received by the agreed date, the Company reserves the right to refuse to attend the Event. In such cases, full payment will still be required, as this will be considered a breach of contract.
10. Music and Entertainment Provisions
10.1. Microphone Use: The Company will allow use of the microphone for speeches and announcements. However, the Company reserves the right to turn off the microphone and refuse further use in cases of inappropriate language or behaviour that may put the equipment at risk.
10.2. Music Requests: The Company will accommodate song requests from the Client both before the Event and during the evening. However, DJs reserve the right to refuse to play any client-provided music unless arranged prior to the Event, for legal reasons.
10.3. Playlist Limitations: The Company cannot be held responsible for the unavailability of any specific music request.
11. Conduct and Security
11.1. Client Responsibility: The Client will ensure that all attendees conduct themselves in a proper manner. The Company will not be held responsible for any actions, behaviour, or damage caused by those attending the Event under any circumstances.
11.2. Zero Tolerance Policy: Mouse Music Group operates a zero-tolerance policy regarding abuse of its Staff, whether verbal or physical, actual or implied.
11.3. Dispute Resolution Procedure: In the event of any actual or threatened abuse, the DJ will turn the music down and request that the matter be addressed. The music will remain at a reduced volume for up to 10 minutes. If the issue is not resolved within this timeframe, the DJ reserves the right to refuse to continue playing and may pack up and leave.
11.4. Financial Implications of Early Termination: In circumstances where the DJ is forced to leave due to unresolved abuse or misconduct, the full fee remains payable, and any damages or losses will be reclaimed from the Client.
12. Photography and Promotional Use
12.1. Event Photography: Mouse Music Group may take digital photographs throughout the Event for use on the Company's website and in further advertisements.
12.2. Opt-Out Option: Should the Client not wish for any photographs to be taken, they must notify the Company in writing before the date of the Event.
12.3. Photo Availability: Copies of photographs and videos, if available, may be obtainable from the Company upon request.
13. Catering and Refreshments
13.1. Staff Provisions: Food and beverage supplies are not required for the Company's Staff unless otherwise agreed upon in advance.
13.2. Participation in Catering: The Company's Staff will not participate in any buffet or food service unless explicitly invited by the Client.
14. Liability and Insurance
14.1. Service Quality: Mouse Music Group will not be responsible for any reduction in service or standards of service resulting from timing issues or constraints imposed by the Client, Venue, or third-party service providers.
14.2. Insurance Recommendation: The Company strongly recommends that Clients obtain event or wedding insurance to cover any unforeseen circumstances.
15. Complaint Procedure
15.1. Submission of Complaints: In the unlikely event that the Client is dissatisfied with the service received, any complaints must be submitted in writing within 7 days of the Event.
15.2. Individual Assessment: All complaints will be dealt with on an individual basis. The acceptance of a complaint does not constitute an admission of fault or blame by the Company.
16. Child Supervision
16.1. Parental Responsibility: Supervision of any children attending the Event is the responsibility of their parents or designated guardians.
16.2. Music for Children: The Company can provide music suitable for children if required, however, responsible adults must be present throughout the Event.
17. Amendments to Terms and Conditions
17.1. Right to Modify: Mouse Music Group reserves the right to amend these Terms and Conditions without prior notice.
17.2. Exceptional Circumstances: Any exceptional or unforeseen circumstances not covered by these Terms and Conditions will be addressed on an individual basis, and the Company's decision in such matters shall be final.
18. Acceptance of Terms
By paying a deposit or any outstanding amount, the Client acknowledges that they have read, understood, and accepted these Terms and Conditions in their entirety. This acceptance constitutes a binding contract between the Client and Mouse Music Group Ltd.
